Welcome to Zemto Eats. These Terms govern your use of the Zemto Eats website, applications, products, and services (“Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Zemto account and place orders. By using the Services you represent and warrant that you meet the eligibility requirements and have the legal authority to agree to these Terms.
2. Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. Notify us immediately at support@zemto.com of any unauthorized use. Zemto reserves the right to suspend accounts for suspicious activity.
3. Ordering & Delivery
Orders placed through Zemto Eats are fulfilled by partner restaurants and couriers. Delivery times are estimates and may vary due to factors outside our control. If items are unavailable or substitutions are required, we will attempt to contact you or credit your Zemto account.
Zemto reserves the right to limit or refuse service in cases of abuse, fraud, or operational constraints.
4. Zemto Gold Membership
Zemto Gold provides benefits such as free delivery, credits, and concierge support. Membership fees are billed monthly or annually and renew automatically until canceled. You may pause or cancel in the app at any time. Benefits are non-transferable except where family sharing is explicitly offered.
5. Payments & Credits
By providing a payment method, you represent that you are authorized to use it. Charges include item prices, taxes, fees, and tips. Credits or promotions may be subject to additional terms, expiration dates, and maximum redemption amounts.
6. Community Guidelines
We expect respectful interactions among customers, couriers, and restaurant partners. Harassment, discrimination, or abusive behavior may result in account suspension or termination.
7. Intellectual Property
Zemto Eats retains all rights to its trademarks, branding, and platform content. You may not reproduce, distribute, or modify any part of the Services without prior written permission. User-generated content remains yours, but you grant Zemto a non-exclusive license to use it in connection with providing the Services.
8. Disclaimer & Limitation of Liability
The Services are provided “as is.” Zemto disclaims all warranties to the fullest extent permitted by law. Zemto is not liable for indirect or consequential damages. Our total liability for any claim related to the Services will not exceed the amounts paid by you to Zemto in the three months preceding the claim.
9. Dispute Resolution
Disputes will be resolved through binding arbitration on an individual basis, unless prohibited by law. You waive the right to participate in class actions or class-wide arbitration. For more details, contact legal@zemto.com.
10. Changes to These Terms
Zemto may update these Terms periodically. We will notify you of material changes via email or in-app notifications. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
